Statutory Text (17 Provisions)
1. The Heads of Office of the Directorate of Security are responsible for the approval of
a. one-time expenditures exceeding CHF 100,000 up to CHF 300,000;
b. recurring expenditures exceeding CHF 75,000 up to CHF 100,000.
1. The heads of departments of the General Secretariat are responsible for the approval of
a. * one-time expenditures exceeding CHF 20,000 up to CHF 100,000;
b. * recurring expenditures exceeding CHF 20,000 up to CHF 75,000.
1. The Head of the Legal Service of the Government Council and the Cantonal Council is, in addition to § 1, responsible for approving
a. * one-time expenditures of more than CHF 20,000 up to CHF 100,000;
b. * recurring expenditures of more than CHF 20,000 up to CHF 75,000.
1. The Head of the Civil Law Administration is, in addition to § 1, responsible for approving
a. * one-time expenditures exceeding CHF 20,000 up to CHF 100,000;
b. * recurring expenditures exceeding CHF 20,000 up to CHF 75,000.
1. The Deputy Command Leader and the Heads of Major Departments of the Basel-Landschaft Police are each responsible for the approval of
a. * one-time expenditures of more than CHF 20,000 up to CHF 100,000;
b. * recurring expenditures of more than CHF 20,000 up to CHF 75,000.
1. The Deputy Head of the Agency, the Head of the Staff Division, as well as the Head and their deputy of the Asylum and Return Department of the Office for Migration, Integration, and Civil Rights are each responsible for authorizing
a. * one-time expenses exceeding CHF 20,000 up to CHF 100,000;
b. * recurring expenses exceeding CHF 20,000 up to CHF 75,000.
1. The Chief Department Heads of the Office for Military and Civil Protection are responsible for the approval of
a. * one-time expenditures exceeding CHF 20,000 up to CHF 100,000;
b. * recurring expenditures exceeding CHF 20,000 up to CHF 75,000.
1. The Head of the Motor Vehicle Inspection Office is, in addition to § 1, responsible for the approval of
a. * one-time expenditures exceeding CHF 20,000 to CHF 100,000;
b. * recurring expenditures exceeding CHF 20,000 to CHF 75,000.
1. The heads of the main departments, as well as, in addition to § 1, the head of the correctional services office, are responsible for the approval of
a. * one-time expenditures exceeding CHF 20,000 up to CHF 100,000;
b. * recurring expenditures exceeding CHF 20,000 up to CHF 75,000.
1. The Head of the Juvenile Prosecutor's Office is, in addition to § 1, responsible for the approval of
a. * one-time expenditures of more than CHF 20,000 up to CHF 100,000;
b. * recurring expenditures of more than CHF 20,000 up to CHF 75,000.
1. The Head of the Department of the Public Prosecutor's Office shall, in addition to § 1, be responsible for the approval of
a. * one-time expenditures of more than CHF 20,000.- up to CHF 100,000.-;
b. * recurring expenditures of more than CHF 20,000.- up to CHF 75,000.-.
1. The approval of expenditures takes place within the special authority of the Directorate in accordance with § 39 paragraph 4 Vo FHG as a payment instruction for
a. Expenditures for the execution of criminal and juvenile criminal measures;
b. * Expenditures for criminal prosecution (e.g., compensation for interpreters, expert opinions, costs for evidence collection, etc.);
c. * Expenditures for persons in custody.
2. As legal decisions pursuant to § 41 paragraph 1 letter c Vo FHG, the following are particularly applicable to the area of the Public Prosecutor's Office
a. Orders to discontinue proceedings;
b. Penal orders;
c. Decisions not to proceed;
d. Orders regarding compensation for official defense counsels and free legal aid for private plaintiffs;
e. Orders regarding party compensations, satisfaction, and compensation claims.
1. In the absence of the persons listed in §§ 1-11, the deputies are responsible for the corresponding expenditure authorizations.
1. The further delegation of responsibilities pursuant to Sections 1-11 is not permitted.
1. The offices ensure the decentralized storage of expenditure approvals within their area.
1. There shall be no reconciliation of expenditure authorizations issued pursuant to this regulation.
1. This regulation, as well as any amendments thereto, shall be published in the collections of laws.
