A property owner sought the right of repurchase (*Heimschlag*) following the listing of a farmhouse for protection, arguing this constituted a material expropriation under cantonal law. The court reasoned that the right of repurchase is permissible if the listing causes material expropriation, which occurs when the protective measure prevents a use of the property that is customary, economically sensible, and reasonable, distinguishing the situation from mere partial building prohibitions. Although protecting the exterior of the building was deemed compatible with continued customary use, the court found that the protection of the building's interior prevented residential use adequate to modern standards, concluding that a material expropriation had occurred, thereby granting the appeal and allowing the repurchase claim.
