The present agreement contains provisions regulating the effects of the transfer of the municipal commune of Moutier (hereinafter: "the commune of Moutier") to the Republic and Canton of Jura (hereinafter: "the canton of Jura") in the field of agriculture, specifically regarding direct payments, support for farming enterprises, and structural improvements.

1 The operators of an agricultural enterprise located within the territory of the municipality of Moutier shall remain members of the ecological networks of the canton of Bern pursuant to Articles 61 and 62 of the Federal Ordinance of 23 October 2013 on Direct Payments (OPD) in which they are integrated, until the expiry of the current contracts on 31 December 2027.

2 The canton of Bern delegates the execution of these contracts to the canton of Jura, as well as the assumption of the financial obligations related to these contracts starting from 1 January 2026 until their expiration.

1. The operators of an agricultural operation located within the territory of the commune of Moutier shall remain members of the programs of the canton of Bern as defined in Articles 63 and 64 of the OPD, in which they are integrated, until the expiration of the current contracts, namely December 31, 2027.

2. The canton of Bern delegates the execution of these contracts to the canton of Jura, as well as the assumption of the financial obligations related to these contracts, from January 1, 2026, until their expiration.

1 The Canton of Bern delegates to the Canton of Jura the execution of the framework agreements "Nature Promotion" that the operators of agricultural areas within the territory of the municipality of Moutier have concluded with the Canton of Bern, starting from January 1, 2026, and until their expiration. The Canton of Jura assumes the obligations, including financial ones, incumbent upon the Cantons.

2 Upon the expiration of these contracts, the Canton of Jura shall propose new ones to the farmers concerned.

1 Subject to paragraph 2, the canton of Bern shall monitor until their complete repayment the credits granted to the operators of a farming business located in the territory of the municipality of Moutier before January 1, 2026, in application of the federal agricultural legislation, which includes all obligations incumbent upon the cantons of Bern and Jura.

2 The canton of Jura shall take over the monitoring of these credits in the following cases

a) when a new credit is granted after January 1, 2026;

b) when there is a need to process a request for subordination, cancellation, or intervention on the real estate mortgages that secure these credits.

3 The takeover of the old credits according to paragraph 2 shall apply only to repayment terms not yet due before January 1, 2026.

4 The following modalities must be respected in case of the takeover of the old credits according to paragraph 2

a) the competent authorities of the cantons of Bern and Jura shall jointly inform the debtor of the debt takeover by the canton of Jura;

b) the canton of Bern shall transfer the mortgage rights securing the credits to the canton of Jura;

c) the canton of Jura shall reimburse the canton of Bern for the balance of the credits.

5 The competent authorities of the cantons of Bern and Jura may agree on a solution different from paragraphs 1 and 2.

1 Notwithstanding Article 7 of the Concordat on the Transfer of Moutier, the Canton of Jura shall assume responsibility for processing cases for which a decision has not been rendered before January 1, 2026.

2 The Canton of Jura shall also assume, as of January 1, 2026, the tasks provided for by Articles 60 to 70 of the Federal Ordinance of November 2, 2022, on Structural Improvements in Agriculture for existing cases.

This agreement enters into force on January 1, 2026.
