Ordinance on Parking Space Management for the Cantonal Administration (PMV) - Subject Matter and Scope (PMV)
Table of Provisions (9)
Statutory Text (9 Provisions)
1. This regulation governs the provision, management, and use of parking and storage spaces owned or leased by the canton (parking management).
2. It applies to all departments and offices of the cantonal administration.
3. It forms part of the Operational Mobility Management (OMM) of the cantonal administration.
1. The canton serves as a role model for traffic management within its own operations.
2. The service and commuting traffic of the cantonal administration should be sustainable and resource-conserving.
3. The canton provides incentives for the use of public transportation and environmentally friendly means of mobility, particularly bicycles and e-bikes, and makes these available to its employees in an appropriate manner for official travel as part of the Business Mobility Management (BMM).
4. The canton manages its parking and bicycle spaces sustainably and avoids creating inappropriate incentives for the use of private cars for official travel and commuting.
1. The government appoints a Parking Commission (PC). This commission consists of at least one representative from each department and constitutes itself.
2. The PC assesses the allocation of required parking spaces concerning the official use of private vehicles and the fee-free issuance of parking permits, while considering the overarching objectives of the Building Management Mandate (BMM).
3. The Agency for Structural Engineering (ASE) is responsible for the parking management of the entire cantonal administration, with the exception of the tasks assigned to the PC. Subject to Paragraph 2, it decides particularly on the allocation of parking permits and can revoke an issued parking permit at any time for important reasons, especially in the event of operational requirements.
1. The canton provides sufficient parking spaces for bicycles and e-bicycles for its employees.
2. Whenever possible, it also offers parking spaces for two-wheeled motorcycles and motorized bicycles.
1. The canton shall provide the necessary parking spaces to offices that rely on the official use of private vehicles by employees, to the extent operationally possible and economically feasible. The necessity exists when no reasonable, economically justifiable alternatives are available.
2. The requirement for the official use of a private vehicle according to paragraph 1 is equivalent to the use of a private vehicle to reach the workplace in connection with work assignments outside the operational hours of public transportation. This particularly applies to shift operations at night.
3. The application for a parking permit must be submitted by the office management to the HBA with sufficient justification.
4. There is no legal entitlement to a parking space.
1. The canton shall, whenever possible, provide employees with physical disabilities, who rely on the use of a private vehicle to commute to work, with a parking space that is accessible for the disabled.
2. The application must be submitted by the employees to the HBA, accompanied by the official disabled parking permit.
1. If there are surplus parking spaces at a site of the cantonal administration, the parking spaces may be used in accordance with the fee regulations.
2. The allocation of surplus parking spaces is primarily based on the travel time by public transport from the place of residence to the workplace. The fastest connection is decisive. Employees with a longer travel time are given priority.
3. In addition, factors such as work hours and the proportion of time spent working from home may be taken into consideration when determining eligibility for parking.
4. A fee-based use of parking can be granted regardless of the travel time by public transport if special circumstances apply to an employee.
5. The application must be submitted by the employees to the HBA.
1. The use of parking spaces is free of charge for
a) Company vehicles;
b) Personal vehicles of employees who possess a parking permit in accordance with Article 5 or Article 6.
2. The use of parking spaces pursuant to Article 4 is free of charge.
3. In all other cases, a fee will be charged to the users.
1. The fees for the use of parking spaces are determined as follows (values include VAT)
a) Covered parking spaces: 120 Swiss Francs per month;
b) Uncovered spaces: 80 Swiss Francs per month;
c) For employees without parking authorization: 5 Swiss Francs per half-day;
d) For third parties: 1.50 Swiss Francs per hour.
2. Parking authorization is ensured through electronic registration or an on-site technical device. The fees according to paragraph 1, items a and b, are deducted from the employees' salary monthly.
3. In case of non-compliance with the fee schedule, the HBA may impose a processing fee of 50 Swiss Francs.
