Agreement on the Bicantonal Event Traffic Coordination Office St. Jakob - Scope, Purpose

1. For the optimization of traffic operations in the St. Jakob area, and for the planning and coordination of traffic during events, the Cantons of Basel-Stadt and Basel-Landschaft jointly operate an office.

2. The name of the office is "Bicantonal Office for Event Traffic St. Jakob" (hereinafter referred to as "Bicantonal Office").

3. This agreement regulates the collaboration between the Cantons of Basel-Stadt and Basel-Landschaft regarding the tasks of the Bicantonal Office.

4. The agreement governs the forms of collaboration between the two cantons, the procedure, the rights and obligations of the Bicantonal Office, and the principles of compensation.

1. The cantons of Basel-Stadt and Basel-Landschaft are each represented by 1 member of the respective executive councils of Basel-Stadt and Basel-Landschaft, namely the heads of the Justice and Security Department of the Canton of Basel-Stadt and the Security Directorate of the Canton of Basel-Landschaft, in the political steering committee. They are responsible for the political governance, particularly in the event of disagreements at the strategic level.

2. A strategic steering body supports the office in matters exceeding day-to-day business or individual events and makes corresponding decisions. The strategic steering body consists of representatives from the cantonal police of Basel-Stadt and Basel-Landschaft, as well as from the Department of Construction and Transportation of the Canton of Basel-Stadt and the Department of Construction and Environmental Protection of the Canton of Basel-Landschaft.

3. The bicantonal office is administratively subordinate to the Justice and Security Department of the Canton of Basel-Stadt.

4. The bicantonal office is based in Basel. Its location can be relocated by resolution of both executive councils.

1. The Bicantonal Office does not possess sovereign powers.

2. It specifically holds the following authorities

a) Within the framework of the tasks assigned to them, the staff of the Bicantonal Office have the right to act independently and responsibly (executive authority).

b) The staff of the office are authorized to perform their official duties according to the administrative agreement in each of the two cantons.

c) Additional implementation and management competencies such as issuance, decision-making, representation, instruction, and control authority are limited to the financial competence granted to the office within the ordinary budget.

d) The financial competence of the office is governed by the directive concerning signatures and visas of the Department of Justice and Security of the Canton Basel-Stadt.

1. The tasks of the Bi-Cantonal Office are jointly defined by the Department of Justice and Security of the Canton of Basel-Stadt and the Directorate of Security of the Canton of Basel-Landschaft.

2. The catalogue of services includes, in particular, the following tasks

a) Development and implementation of solution approaches and an action plan aimed at optimizing and sustainably improving traffic management and flow in the St. Jakob area during events;

b) Acting as a coordination and information center for authorities, infrastructure operators, and event organizers in planning and implementing traffic measures related to events in the St. Jakob area;

c) Incorporating and considering the needs of stakeholder groups affected by event-related traffic (visitors, residents, road users) for a manageable traffic flow;

d) Considering current relevant area developments and anticipating potential traffic impacts on events in the St. Jakob area;

e) Short-, medium-, and long-term coordination of events;

f) Definition and arrangement of responsible organizations and individuals with regard to an event or project;

g) Initiating orders related to tasks defined for the office, within the set budgetary framework;

h) Proactive networking and maintaining relevant contacts with the involved specialist departments;

i) Planning, preparing, recording, and, if necessary, leading meetings and sessions with involved government offices and organizations;

j) Controlling and reporting to the heads of the Department of Justice and Security of the Canton of Basel-Stadt and the Directorate of Security of the Canton of Basel-Landschaft.

3. The tasks are further specified by the heads of the Department of Justice and Security of the Canton of Basel-Stadt and the Directorate of Security of the Canton of Basel-Landschaft as necessary.

4. Adjustments to the catalogue of services are jointly issued by the heads of the Department of Justice and Security of the Canton of Basel-Stadt and the Directorate of Security of the Canton of Basel-Landschaft.

1. Cooperation between the authorities of both cantons must be ensured in the area of event traffic at St. Jakob.

1. The personnel time expenditure for the services to be provided is set at 100 percent of the positions.

2. The two cantons of Basel-Stadt and Basel-Landschaft jointly determine the selection of the staff for the Bicantonal Office.

3. The employment of the staff of the Bicantonal Office is carried out by the canton of Basel-Stadt in accordance with the applicable law. Insofar as the staff are active in the territory and on behalf of the canton of Basel-Landschaft, the law of the canton of Basel-Landschaft is applicable.

4. The employment relationship is established through the conclusion of a public-law employment contract.

1. The location of the Bilingual Service Center is situated within the office premises of the Traffic Police of the Canton of Basel-Stadt, at the Highway Police station, in Basel, and it has access to their services (secretariat, rooms, IT services, facility services, etc.).

2. The infrastructure necessary for the provision of services is provided by the Cantonal Police of the Canton of Basel-Stadt.

3. The office IT infrastructure is connected to the network of the Canton of Basel-Landschaft.

1. The personnel, operational, and material costs arising from the operation of the Bi-Cantonal Office shall be borne equally by both cantons.

2. The Canton of Basel-Stadt shall invoice the Canton of Basel-Landschaft for half of the incurred costs annually in mid-year.

3. Costs incurred by the involved offices for their participation in meetings of the Bi-Cantonal Office, as well as personnel and material expenses arising from organizational and mobility measures concerning event traffic, are not part of the joint cost sharing.

4. Also reserved are expenses carried out exclusively for one canton. This canton shall settle the invoices directly.

5. Both cantons shall jointly determine financially burdensome changes to personnel, operational, and material requirements.

1. The Bi-cantonal Office prepares an annual structured report on the achievement of objectives and any special incidents or events for the heads of the Department of Justice and Security of the Canton of Basel-Stadt and the Security Directorate of the Canton of Basel-Landschaft.

2. The heads of the Department of Justice and Security of the Canton of Basel-Stadt and the Security Directorate of the Canton of Basel-Landschaft jointly evaluate the services provided and set the objectives.

1. If the provisions of this agreement do not lead to a clear decision in a specific case, the heads of the Department of Justice and Security of the Canton of Basel-Stadt and the Directorate of Security of the Canton of Basel-Landschaft shall reach a mutual understanding.

2. Adjustments to this agreement can be made at any time by mutual consent. Such adjustments must be in written form.

1. This Agreement is valid for an indefinite period and may be terminated by either party at the end of any calendar year by giving 12 months' written notice.
