Agreement on Cooperation between the Cantons of Basel-Stadt and Basel-Landschaft in the Recording of Biometric Data for Swiss Passports (Biometric Data Agreement BS-BL) - Scope (BS-BL)

1. The Cantons of Basel-Stadt and Basel-Landschaft grant Swiss citizens residing in the respective neighboring canton the option to have their biometric data for Swiss passports recorded either in Basel-Stadt or Basel-Landschaft.

1. Applications for passports from Swiss citizens residing in the canton of Basel-Stadt must be submitted exclusively at the Basel-Stadt Passport Office. The Basel-Stadt Passport Office reviews the data and enters it into the Travel Document Information System (ISA).

2. The applicant may choose to have the biometric data captured either in Basel-Stadt or Basel-Landschaft. If the applicant desires the capture of biometric data in Basel-Landschaft, the Basel-Stadt Passport Office remains responsible. The Basel-Stadt Passport Office enables the data in the system for the Basel-Landschaft Passport Office.

3. If biometric data capture in Basel-Landschaft is desired, the applicant schedules an appointment with the Basel-Landschaft Passport Office by telephone.

4. Upon the recording of biometric data by the Basel-Landschaft Passport Office, the fee is collected and the passport order is initiated.

1. For the Swiss citizens residing in the Canton of Basel-Stadt who have their data registered in the Canton of Basel-Landschaft, Basel-Landschaft reimburses half of the fees allocated to the cantons to Basel-Stadt. The transfers are made monthly within 10 days, accompanied by a list of payment receipts.

1. Passport applications from Swiss citizens residing in the Canton of Basel-Landschaft must without exception be submitted to the Passport Office Basel-Landschaft. The Passport Office Basel-Landschaft verifies the data and enters it into the Identification Documents Information System (ISA).

2. The applicant may request that the collection of biometric data take place in Basel-Landschaft or Basel-Stadt. If the applicant wishes for the biometric data collection to occur in Basel-Stadt, the Passport Office Basel-Landschaft nevertheless remains responsible.

3. Should the Passport Office Basel-Landschaft collect biometric data from Swiss citizens residing in the Canton of Basel-Landschaft at the passport office location in Basel-Stadt, this is done with personnel from the Canton of Basel-Landschaft.

4. Basel-Stadt collects the payments from Swiss citizens residing in the Canton of Basel-Landschaft at the existing cash terminal.

1. The Passport Office of Basel-Landschaft serves its customers in the premises of the Passport Office of Basel-Stadt.

2. The Canton of Basel-Stadt provides space for the installation of a biometric data capture booth for the Canton of Basel-Landschaft.

1. The canton of Basel-Landschaft installs a server of the canton of Basel-Landschaft at the Basel-Stadt location.

1. The Canton of Basel-Stadt shall transfer all revenues from citizens of the Canton of Basel-Landschaft to the Canton of Basel-Landschaft on a monthly basis.

2. The Canton of Basel-Landschaft shall pay a flat fee for the use of premises, infrastructure (e.g., waiting room, cashier, sanitary facilities, cleaning). This fee shall be based on the costs incurred by the Canton of Basel-Stadt.

3. The Canton of Basel-Stadt shall invoice the Canton of Basel-Landschaft at the beginning of each year for the entire year.

4. The Executive Councils of the Cantons of Basel-Stadt and Basel-Landschaft shall jointly determine the amount of the flat fee.

1. The delivery of identity documents shall occur either at the location where the client's biometric data was recorded, or at the client's residential address.

1. The deposit of the exchange passport can only occur in the canton of residence with the responsible authority or with the employer.

1. For ensuring information security and the protection of personal data processed by the personnel of the Canton of Basel-Landschaft within the premises of the Canton of Basel-Stadt, the responsibility lies with the Canton of Basel-Landschaft.

2. The Canton of Basel-Stadt ensures information security and the protection of personal data at the Spiegelhof location, insofar as this can be influenced by structural measures.

3. The Canton of Basel-Landschaft ensures information security and the protection of personal data processed by the passport office of Basel-Landschaft for Swiss citizens residing in the Canton of Basel-Stadt.

1. The agreement is concluded for an indefinite period.

2. The agreement may be terminated by either party at the end of any year, subject to a 12-month notice period.

1. In the event of disputes arising from this agreement, Articles 31 et seq. of the Framework Agreement for Intercantonal Cooperation with Burden Sharing of June 24, 2005 (Framework Agreement, IRV) shall apply.
