Decision Summary (Facts, Holding & Outcome)

AI-structured

The Federal Administrative Court granted the complaint against the non-admission of an appeal and referred the case to the Senate for substantive judgment, thereby advancing the proceedings. The dispute concerns telecommunications regulation, specifically whether the national telecommunications agency possesses a margin of discretion when determining hourly rates for efficient cost estimation under specific provisions of the Telecommunications Act. The decisive legal basis includes § 132 Abs. 2 Nr. 1 VwGO regarding the fundamental significance of the legal question, and § 31 Abs. 2 Satz 1 TKG and § 32 Abs. 1 Satz 1 TKG (as amended in 2012) governing the agency's cost-calculation duties and the scope of judicial review.
