Case Number 98.99.12 (UR_REB_001_98-99-12_1999-07-20)
Court / Authority
Decision Date
Outcome Allowed / Granted
Jurisdiction Canton of Uri — Cantonal Courts (CH-UR)

Decision Summary (Facts, Holding & Outcome)

AI-structured

The court addressed the requirement for official defense counsel in appellate proceedings, noting that under the relevant statute, the President of the court of appeal is responsible for appointing such counsel. The court reasoned that because the appellate phase involves a different instance and distinct considerations, such as the significance of the appeal to the defendant and the likelihood of success in the specific case, a new application for official defense counsel is necessary, and the prior determination does not automatically carry over.

Full Text of the Judgment — 98.99.12

98/99 12 Strafprozessordnung. Art. 56 Abs. 1 StPO. Amtliche Verteidigung.

Niklaus Oberholzer, a.a.O., S. 174; Thomas Hansjakob, a.a.O., S. 435).
