Case Number 98.99.01 (UR_REB_001_98-99-01_1999-07-28)
Court / Authority
Decision Date
Outcome Inadmissible
Jurisdiction Canton of Uri — Cantonal Courts (CH-UR)

Decision Summary (Facts, Holding & Outcome)

AI-structured

A party failed to meet the deadline for submitting a required court cost advance payment by using the post's bulk order service, as the deadline expired on March 1, 1999. The court reasoned that under the relevant procedural law, the deadline is met if the action is taken on the last day, and for payments via the post's bulk service, the payment data carrier must be handed over to the post by the deadline, showing the due date as no later than the final day of the period; since the data carrier was handed over on March 2, 1999, with a corresponding due date of March 2, 1999, the payment was not timely, leading to the non-admittance of the appeal.

Full Text of the Judgment — 98.99.01

98/99 1 Zivilprozessordnung. Art. 74 Abs. 1 ZPO.
