Decision Summary (Facts, Holding & Outcome)

AI-structured

In appeals concerning premium reductions, the social insurance institution, even if unsuccessful, is not obligated to bear court costs. This is because, as an entity entrusted with implementing public duties under the law, it is considered an "administrative office" for the purposes of cost allocation in administrative proceedings, and such entities are generally exempt from bearing costs in appeal procedures. This aligns with federal practice where cost exemptions are applied to all bodies carrying out public responsibilities.

I. Prozessrecht

35 § 31 Abs. 4 EG KVG, § 33 Abs. 2 und § 35 Abs. 1 VRPG Im Beschwerdeverfahren betreffend Prämienverbilligung hat die Sozial- versicherungsanstalt als unterliegende Partei keine Verfahrenskosten zu tragen (Erw. 3).

Aus dem Entscheid des Versicherungsgerichts, 4. Kammer, vom 15. Okto- ber 2002 in Sachen M.V. gegen Sozialversicherungsanstalt.

*Aus den Erwägungen*

Fritz Gygi, Bundesver- waltungsrechtspflege, 2. Aufl., Bern 1983, S. 329).
