Legislator-Zusammenfassung

KI-generiert

A party filed an appeal challenging a resolution concerning the partial revision of a territorial plan, specifically regarding a road designation, but the appeal was deemed moot because the relevant road had subsequently been approved by the State Council. The court reasoned that it has the authority to strike appeals that become without object during proceedings and found the appellant to be the losing party because the governmental confirmation rendered their doubts unfounded and their appeal premature, leading the court to strike the appeal from the record and order the appellant to pay the judicial costs.

Incarto n. 90.97.00122 · Lugano 17 novembre 1997 · In nome della Repubblica e Cantone del Ticino Il Tribunale della pianificazione del territorio

composto dai giudici: · Efrem Beretta, presidente, Giovanna Roggero-Will, Michele Rusca

Il segretario · Fiorenzo Gianinazzi

visto il ricorso del 28 agosto 1997 di

__________ __________, __________, rappr. da: avv. __________ __________, __________ __________, contro

la risoluzione del Consiglio di Stato 9 luglio 1997 relativa alla revisione parziale del PR di __________;

visto le osservazioni 31 ottobre 1997 del Consiglio di Stato che chiede che il ricorso venga giudicato senza oggetto in quanto la strada di PR n. __________è stata approvata dal Consiglio di Stato; spese e tasse a carico della ricorrente;

visto le osservazioni 20 ottobre del Comune di __________ che chiede venga giudicato come chiesto nel ricorso della __________ __________;

preso atto dello scritto 11 novembre 1997 della __________ __________ che chiede lo stralcio del ricorso e la conferma del fatto che la strada di servizio 17 è stata approvata;

considerato in fatto e diritto:

che il tribunale procede, d’ufficio o su richiesta di una parte, allo stralcio dei ricorsi che nel corso del procedimento diventano privi di oggetto, rispettivamente di interesse giuridico;

che a norma dell’art. 28 LPamm, applicabile in forza del richiamo dell’art. 38 cpv. 6 LALPT, il TPT può applicare alle proprie decisioni una tassa di giustizia alla parte soccombente;

che soccombente è in linea di principio l’autorità che rivede nel senso postulato dal ricorrente la decisione impugnata (acquiescenza), rispettivamente il ricorrente che ritira il gravame (desistenza) o comunque si assoggetta, espressamente o implicitamente alla decisione impugnata;

che soccombente è in concreto la ricorrente; infatti la conferma governativa (che la ricorrente avrebbe dovuto sollecitare nelle forme di un’istanza di interpretazione rivolta all’ente decidente, anziché adire subito il TPT) rende palese l’infondatezza dei dubbi (e peraltro l’intempestività del ricorso da presentarsi solo se l’interpretazione avesse escluso l’approvazione della strada);

Per questi motivi,

dichiara e pronuncia

1. Il ricorso é stralciato dai ruoli.

.

2. La ricorrente é condannata al pagamento di fr. 200.- di tasse di giudizio.
