Statutory Text (26 Provisions)
1. Questo regolamento si applica ai dati geospaziali di base del diritto cantonale e ad altri dati geospaziali del Cantone e dei comuni.
2. Si applica anche ai dati geospaziali di base del diritto federale, a meno che il diritto federale o il restante diritto cantonale non contengano disposizioni divergenti.
3. L'allegato 3 contiene il catalogo dei dati geospaziali di base del diritto cantonale.
4. Rimangono riservate particolari disposizioni di legge settoriali.
1. Le seguenti ordinanze sono abrogate
a) Ordinanza relativa alle tasse per il rilevamento ufficiale
b) Ordinanza sulla coordinazione dei dati digitali geospaziali (Ordinanza sui geodati)
1. Per tutti i dati geobasici si applicano il sistema di riferimento e il quadro di riferimento della misurazione ufficiale.

1. Tutti i dati geobase sono descritti attraverso metadati geografici. Il Dipartimento dell'economia pubblica stabilisce la norma per i metadati geografici. I metadati geografici sono soggetti, per analogia, alle stesse disposizioni dei corrispondenti dati geobase.
1. Lo scambio di dati geobase avviene nella forma e nel formato dei modelli di dati vincolanti per i dati geobase pertinenti.
1. I dati geobase sono accessibili tramite un pool centrale di dati geobase.
1. I dati geospaziali di base possono essere resi accessibili e utilizzabili tramite i seguenti servizi geografici
a) tramite servizi di visualizzazione
b) tramite servizi di download
c) tramite servizi di portale
2. L'accesso ai dati geospaziali di base e ai servizi geografici è stabilito attraverso livelli di autorizzazione nel catalogo dei dati geospaziali di base. La definizione dei livelli di autorizzazione si conforma alle disposizioni della legislazione federale.
1. Responsabile per la creazione e gestione del pool di dati geobasici e dei servizi geospaziali è l'Ufficio per l'Informazione Geografica.
1. I titolari dei dati aggiornano i dati geobasici e li forniscono senza ritardi nella forma e nel formato prescritto all'Ufficio per l'informazione geografica.
2. Possono anche delegare questo compito a terzi.
1. I titolari dei dati storicizzano i dati geobasici in modo tale che ogni stato giuridico possa essere ricostruito con sufficiente certezza e uno sforzo ragionevole entro un termine utile.
2. Il metodo di storicizzazione viene documentato.

1. I responsabili dei dati sono responsabili per l'archiviazione dei dati geobase.

1. L'Ufficio per l'informazione geografica gestisce il catasto delle restrizioni di diritto pubblico della proprietà (Catasto dei DRE) ed è responsabile della redazione e del rilascio di estratti certificati, nonché della stipula dell'accordo di programma con il DDPS (Dipartimento della difesa, della protezione della popolazione e dello sport).
1. Il catalogo dei dati geobase indica i set di dati ai quali sono associate informazioni relative alle modifiche in corso nel registro degli oneri sugli atti privati e pubblici (pre-pubblicazione).
2. L'organo competente per l'emanazione adotta la relativa registrazione al più tardi con l'inizio della pubblica esposizione.
3. La registrazione nel registro degli oneri sugli atti privati e pubblici non produce effetti giuridici.
1. Contenuto e progettazione tecnica del catasto delle condutture sono disciplinati dalle disposizioni pertinenti delle associazioni di settore.
1. L'Ufficio di Geoinformazione può offrire servizi aggiuntivi ai comuni e ad altri interessati.
1. L'accesso standardizzato ai dati geografici di base tramite i servizi geografici forniti dall'Ufficio per l'informazione geografica è esente da tasse.
2. Per il resto, per l'accesso ai dati geografici di base e il rilascio di estratti autenticati vengono applicate delle tasse. Queste sono calcolate secondo il regolamento delle tasse approvato dal Consiglio di Stato dell'Ufficio per l'informazione geografica.
1. Lo scambio reciproco dei dati geospaziali tra il Cantone e i comuni di Sciaffusa è gratuito.
1. Nel processo di aggiornamento del catalogo dei dati geospaziali di base e nella designazione dei modelli di dati da applicare è da coinvolgere in veste consultiva il gruppo strategico per i dati geografici.
2. Questo è composto da
a) Capo del Dipartimento dell'Economia Pubblica in qualità di Presidente
b) un rappresentante ciascuno della città di Sciaffusa e di Neuhausen am Rheinfall
c) un rappresentante designato dai presidenti degli altri comuni
d) un rappresentante della sezione SIA di Sciaffusa
e) Direzione dell'Ufficio di Geoinformazione
f) Direzione dell'Ufficio per la Pianificazione e Protezione della Natura
g) Direzione della KSD
3. I compensi di partecipazione per i membri esterni del gruppo strategico per i dati geografici sono determinati secondo i criteri di cui al § 81 comma 1 e § 82 comma 5 del Regolamento del Consiglio Cantonale del 20 dicembre 1999.
1. L'abrogazione e la modifica delle leggi precedenti sono disciplinate nell'Allegato 1.
1. Il Consiglio di Governo stabilisce negli allegati 2 e 3 a quali dati geospaziali di base si debba assegnare quale livello di priorità durante la transizione verso i nuovi requisiti qualitativi e tecnici.
2. Per la raccolta e la garanzia della disponibilità dei dati geospaziali di base si applicano i seguenti termini a partire dall'entrata in vigore del presente regolamento
a) Livello di priorità 1: quattro anni
b) Livello di priorità 2: otto anni
c) Livello di priorità 3: a discrezione dell'autorità competente
3. Se per l'attuazione sono necessarie norme tecniche e direttive che non sono ancora esistenti al momento dell'entrata in vigore del presente regolamento, i termini previsti al comma 2 iniziano a decorrere dal momento in cui queste vengono comunicate alle autorità competenti.
1. Questo regolamento entra in vigore il 1º gennaio 2014.
2. Deve essere pubblicato nella Gazzetta Ufficiale e inserito nella raccolta delle leggi cantonali.
