Art. 38b : Legge sulla giustizia amministrativa (VRG)

Art. 38b

49 1 Un membro a tempo pieno o parziale decide come giudice unico sui ricorsi,

a. che sono manifestamente inammissibili,

b. che sono stati ritirati o sono divenuti altrimenti privi di oggetto,

c. il cui valore litigioso non supera i Fr. 20 000,

d. in controversie concernenti

1. provvedimenti amministrativi nella circolazione stradale,

2. l'esecuzione di pene e misure dopo la Legge sull'esecuzione delle pene e delle misure del 19 giugno 200613,

3. la dispensa dal segreto professionale,

4. misure di tribunali di prima istanza secondo il § 43 cpv. 1 lett. a–c.

2 In casi di importanza fondamentale, la decisione può essere deferita

a una camera.

3 Se sono impugnate decisioni del Consiglio di Stato, la valutazione

del giudice unico è esclusa nei casi di cui al cpv. 1 lett. c e d.
