1. Salvo i casi in cui è applicabile l'articolo 88 paragrafo 5, la commissione di ricorso concede alla parte vincitrice, in tutto o in parte, il rimborso delle spese necessarie da essa sostenute (spese vive), su richiesta.
2. L'indennità viene quantificata nel dispositivo e imposta al fondo statale e comunale, a meno che per ragioni di equità non possa essere imposta alla parte soccombente.
3. Alle autorità o alle organizzazioni incaricate di compiti pubblici, che prevalgano, di norma non deve essere concessa alcuna indennità di parte.
