Art. 73 Legge sulla costruzione e sull'assetto del territorio (LCAT)

1 Il consiglio comunale trasmette senza indugio, per approvazione, al Servizio di pianificazione territoriale i piani e le prescrizioni adottati; allega tutti i documenti utili, comprese le opposizioni e le osservazioni derivanti dall'indagine, il verbale delle sedute di conciliazione, le sue proposte motivate relative alle opposizioni non ritirate, nonché il verbale delle sedute del consiglio comunale o dell'assemblea comunale.

2 Il Servizio di pianificazione territoriale verifica l'opportunità di tali piani e prescrizioni e la loro conformità alla legge e all'interesse pubblico; può, dopo aver consultato il consiglio comunale e i proprietari interessati, modificare le prescrizioni che sono contrarie a questi principi; inoltre, delibera sulle opposizioni.

3 L'atto di approvazione può, entro 30 giorni, essere oggetto di ricorso presso il Tribunale amministrativo, che dispone di un libero potere di esame ai sensi dell'articolo 33, comma 3, lettera b, della legge federale sulla pianificazione territoriale; hanno diritto di ricorrere gli oppositori e il comune.
