Art. 52 Legge sull'assistenza sociale pubblica (Legge sull'assistenza sociale, SHG) - Tutela giuridica · Tutela giuridica

1. Contro le decisioni dei servizi sociali e degli enti pubblici e privati nell'ambito di competenza dei comuni è possibile presentare ricorso alla prefetta o al prefetto del governo. Contro le decisioni di enti pubblici o privati nell'ambito di competenza della Direzione della sanità, del sociale e dell'integrazione è possibile presentare ricorso a quest'ultima.

2. In sostituzione della prefetta o del prefetto del governo, è la Camera dei tutori a decidere sui ricorsi contro le decisioni delle autorità di assistenza sociale della Burgergemeinde di Berna e delle sue corporazioni e società. Il Consiglio di Stato disciplina l'organizzazione della Camera dei tutori mediante regolamento.

3. Le decisioni sui ricorsi sono soggette a ricorso al tribunale amministrativo.

4. Per la rappresentanza in giudizio davanti agli organi di ricorso sono ammesse persone e organizzazioni a libera scelta del ricorrente.
