1. Per la decisione sulla domanda di assistenza legale gratuita non vengono imposte spese processuali; l'avvocata o l'avvocato è compensato, in caso di nomina ufficiale, secondo le disposizioni particolari della legislazione forense. Alla parte avversa che prevale nel procedimento della domanda non spetta un rimborso delle spese legali.
2. La domanda e il procedimento sono altresì regolati dalle disposizioni del Codice di procedura civile svizzero.
3. Se il diritto all'assistenza legale gratuita viene rifiutato o revocato, tale decisione è soggetta allo stesso mezzo di impugnazione applicabile alla questione stessa. Il comma 1 si applica mutatis mutandis.
4. L'avvocata o l'avvocato e la parte rappresentata possono impugnare la decisione sull'ammontare del compenso con lo stesso mezzo di impugnazione applicabile alla questione stessa.
