Sintesi della sentenza (Oggetto del contendere & Esito)

Generato dall'IA

The court established a new practice regarding the instruction for remedies in state liability cases, departing from the previous requirement for a second instance review by the Cantonal Court, based on a Federal Supreme Court ruling concerning medical malpractice cases. The Federal Supreme Court held that medical liability claims, regardless of their legal basis (public or private law), can be directly appealed to the Federal Supreme Court via a civil law appeal, but this precedent should not be extended to other areas of state liability, which generally fall under public law appeals; consequently, there is no longer a possibility to appeal the first instance final decision of the Administrative Court to the Cantonal Court in these state liability matters, although regional courts remain competent for medical liability cases in the first instance.

10/23 Verfahren PVG 2022

23 Verfahren.
