Sintesi della sentenza (Oggetto del contendere & Esito)

Generato dall'IA

The court found that the provision excluding a spouse working in the other spouse's business from being considered an employee for the purpose of child allowances is unconstitutional. The court reasoned that this exclusion violates constitutional principles of equality by denying child allowances to individuals who, despite their spousal relationship, would otherwise qualify as employees based on their earnings, which is consistent with similar rulings in other cantonal courts.

AGVE 2001 32 S.107

2001 Kinderzulagen 107

II. Kinderzulagen
