The Federal Administrative Court dismissed the plaintiff's objection against the cost determination order, thereby upholding the defendant's attorney's claim for cost reimbursement. The dispute concerned the enforceability of a prozessual (procedural) cost reimbursement claim originating from a 2001 federal administrative judgment, where the plaintiff invoked material defenses of statute of limitations and forfeiture due to the lapse of more than ten years. The court ruled that while material defenses are generally excluded from the cost determination proceeding and must be raised via an execution defense action, they may exceptionally be considered if the facts are undisputed; applying this exception, the court found the statute of limitations defense invalid because the limitation period for procedural cost claims is thirty years, and the forfeiture defense failed because the plaintiff did not demonstrate the requisite conduct element beyond the mere passage of time, thus finding no violation of good faith.
