The Federal Administrative Court allowed the defendant's appeal and admitted the revision appeal, ruling in favor of the defendant on the procedural question of admissibility. The dispute concerned the compatibility of the German state monopoly on sports betting with EU law, specifically challenging the actual implementation of the monopoly regarding advertising practices. The court determined that the case possesses fundamental significance under § 132(2)(1) of the Code of Administrative Court Procedure (VwGO), identifying two key legal questions requiring clarification: whether the review of the monopoly's advertising structure must be applied uniformly across the federation or tailored to individual states due to federal constitutional autonomy, and whether compliance with the EU coherence requirement depends on a consequential analysis of migration towards more liberalized gambling sectors. Other grounds for admission under § 132(2)(2) and (3) VwGO were deemed irrelevant in light of the successful fundamental significance claim.
