Reliability check in unscheduled Weapons Act inspections following recent annual hunting license extension
Sintesi Legislator
Generato dall'IAThe Federal Administrative Court granted the plaintiff’s leave to appeal on the basis of fundamental significance, allowing the case to proceed to the Federal Administrative Court for a review that is currently pending. The dispute concerns the requirement for a renewed reliability check under the Federal Weapons Act when a weapon holder, whose permit had recently been extended as an annual hunting license, undergoes an unscheduled inspection approximately two years after the last periodic review. The decisive legal issues center on the interpretation of § 4 Abs. 3 of the Federal Weapons Act and its interplay with § 17 Abs. 1 Satz 2 of the Federal Hunting Act, specifically whether a prior reliability assessment for the hunting license negates the need for a separate, person-specific reliability review in the subsequent unscheduled inspection.

Testo completo
