Mandatory reliability review under Weapons Act following issuance of annual hunting license
Sintesi Legislator
Generato dall'IAThe BVerwG 6th Senate granted leave to file an appeal on points of law, thereby permitting the case to proceed to the full Federal Administrative Court, without altering the lower court's judgment which remains in force pending the subsequent appellate hearing. The dispute concerns a challenge to an administrative measure under § 4 Abs. 3 of the Weapons Act (WaffG), specifically questioning whether a reliability review of a firearm license holder is legally mandatory when conducted without a personal trigger event, approximately two years after the last regular review, and following the issuance of a temporary annual hunting license that itself required a separate reliability check under § 17 Abs. 1 Satz 2 of the Federal Hunting Act. The court determined the appeal should be admitted pursuant to § 132 Abs. 2 Nr. 1 VwGO due to the fundamental importance of the legal questions, which remain insufficiently clarified in existing Federal Administrative Court jurisprudence regarding the temporal and procedural prerequisites for mandatory reliability reviews under the Weapons Act.

Revisionszulassung; Überprüfung nach § 4 Abs. 3 WaffG
[GRUENDE]
