The Federal Administrative Court granted leave to appeal, thereby allowing the petitioner to proceed to the next instance and prevailing in this procedural stage. The case involves a dispute regarding the liability for broadcasting fees, specifically challenging whether novel broadcasting reception devices located in a non-exclusively private area but assigned to a property where the taxpayer maintains other private devices constitute exempt "secondary devices." The court found the matter to be of fundamental legal significance, as it requires clarification on the application of the secondary device exemption under § 5(3) of the Broadcasting Fee Statute (RGebStV) to such mixed-use premises, with the admission of revision based on § 132(2)(1) VwGO.

[GRUENDE]

§ 63 Abs. 1 Satz 1 GKG.
