The Federal Administrative Court permitted the plaintiff's appeal to proceed and quashed the lower court's decision, thereby allowing the plaintiff to prevail in the present procedural stage by finding the administrative appeal (Beschwerde) admissible and well-founded. The dispute concerned whether a validly established and proven secret fiduciary arrangement (treuhänderische Bindung) constitutes a relevant factor in calculating eligibility for educational funding benefits, a question where the lower court had incorrectly deemed such civil-law agreements irrelevant. The decisive legal basis is the requirement for uniformity in the interpretation of law under § 132(2) No. 2 VwGO, as the lower court had deviated from binding Federal Administrative Court precedents which establish that civil-law fiduciary agreements are legally significant in the context of educational funding.

Ausbildungsförderung; Verbindlichkeit eines Treuhandverhältnisses

[GRUENDE]
