The Federal Court of Criminal Justice (BGH) rejected the defendant's appeal as unfounded, upholding the lower court's order for preventive detention in a psychiatric hospital and confirming the defendant's obligation to bear the costs of the appeal. The dispute concerned the continued validity of a detention order originally issued under the old version of Section 63 of the Criminal Code, challenged in light of a statutory amendment effective August 1, 2016, which retroactively applied to the case pursuant to transitional provisions in the Criminal Code and Code of Criminal Procedure. The court held that the new legislative formulation of the prerequisites for preventive detention was consistent with established constitutional and supreme court jurisprudence, essentially codifying existing case law; therefore, the Landgericht's danger assessment and reasoning satisfied the requirements of the new Section 63 of the Criminal Code, allowing the BGH to exclude any error resulting from the non-application of the amended statute.

Juli 2016 (BGBl.
