The Federal Court of Justice (BGH) rejected the appeal as inadmissible, ruling that the individual plaintiff lacked the standing to challenge the regional court's judgment regarding tax evasion, bribery, and breach of trust. The dispute centered on the plaintiff's attempt to intervene as a private prosecutor (Nebenkläger) and subsequently file an appeal against a verdict that imposed a cumulative custodial sentence for tax evasion while dismissing other charges due to statute of limitations. The decisive legal basis was § 395 Abs. 1 and 3 StPO, which restricts private prosecution to specific cataloged offenses; since tax evasion, bribery, and breach of trust are not included in this catalog, the plaintiff had no right to join the prosecution under § 396 Abs. 1 Satz 1 StPO and consequently lacked the standing to lodge an appeal under § 349 Abs. 1 StPO.

Zulässigkeit der Nebenklage bei Strafverfahren wegen Steuerhinterziehung, Bestechung und Untreue

[TENOR]
