The court addressed the applicability of regulations concerning court holidays to proceedings for granting legal aid under the relevant procedural code, noting the absence of an explicit provision for such application in the legal aid statutes, although summary proceedings are partially incorporated. Reasoning that the legal aid application process shares key characteristics with summary proceedings, such as the principles of acceleration and limited finality, the court determined that the rule excluding court holidays from summary proceedings and subsequent appeals should be analogously applied to the legal aid application procedure.

Rechtsprechung Luzern

Instanz: · Obergericht

Abteilung: · Gesamtobergericht

Rechtsgebiet: · Zivilprozessrecht

Entscheiddatum: · 17.12.1996

Fallnummer: · OG 1996 21

LGVE: · 1996 I Nr. 21
