Cost Appeal on Lost Earnings and Damages Remitted for Initial Adjudication
Sintesi Legislator
Generato dall'IAAn accused party appealed a decision by filing a cost appeal regarding claims for lost earnings and non-pecuniary damages against the state, but the appellate court declined to rule on these claims because the appellant failed to demonstrate that these specific claims had been presented to the lower court for adjudication, adhering to the principle of the appeal process which limits review to issues previously decided by the subordinate instance, consequently remitting the matter to the competent lower court for processing the claims.

LGVE: · 1995 I Nr. 60
Max. XI Nrn. 375 und 451).
