Expedited Document Production Refusal for Easily Obtainable Evidence
Sintesi Legislator
Generato dall'IAIn an expedited order procedure, a party requested the production of a report concerning the delivery of a registered mailing, but the court deemed this request inadmissible because the requesting party stated they would personally obtain proof of delivery. The court reasoned that in summary proceedings, generally only documentary evidence and party examination are permitted, and an application for document production under the relevant civil procedure code sections is excluded when the party bearing the burden of proof can easily obtain the document themselves; failure to submit an easily procurable document in such summary proceedings results in the negative consequences of lacking evidence.

Rechtsprechung Luzern
Instanz: · Obergericht
Abteilung: · I. Kammer
Rechtsgebiet: · Zivilprozessrecht
Entscheiddatum: · 27.06.1991
Fallnummer: · OG 1991 19
LGVE: · 1991 I Nr. 19
Leitsatz: · §§ 148ff. ZPO.
