In this case, the Swiss Federal Tribunal was tasked with reviewing an appeal concerning a decision on the definitive or provisional release of debt enforcement. The matter at hand involved a financial dispute where the contested decision was made subsequent to the enactment of the Federal Act on the Swiss Federal Supreme Court (BGG), which applied to procedures initiated after January 1, 2007. The decision involved a significant financial amount exceeding 30,000 Swiss Francs, meeting the threshold for a civil complaint under the BGG. The appeal was found admissible as the original ruling constituted a final decision in terms of the legal process. The appellant alleged violations of both Swiss federal and foreign laws, which the Federal Tribunal could freely examine. The court also noted that the decision about the debt enforcement did not constitute a provisional measure, allowing broader grounds for complaint under the applicable legal standards.

X. gegen Y. (Beschwerde in Zivilsachen)

5A_44/2007 vom 26. April 2007

Regeste

Entscheid über die definitive oder provisorische Rechtsöffnung.

Eintretensvoraussetzungen und Beschwerdegründe nach BGG.

Erwägungen ab Seite 399

BGE 133 III 399 S. 399

Aus den Erwägungen:

1.

1.1 Das Bundesgesetz vom 17. Juni 2005 über das Bundesgericht (BGG; SR 173.110) ist am 1. Januar 2007 in Kraft getreten (AS 2006 S. 1242).
