Scope of Document Search and Seizure under Administrative Criminal Law The case concerns the permitted scope of searching and seizing documents under Article 50(1) of the Administrative Criminal Law Act (VStrR), which mandates that papers must be searched with the utmost regard for private secrets and only if it is assumed they contain writings relevant to the investigation. The court ruled that this measure is not strictly limited only to documents relevant to the investigation, acknowledging that a pre-seizure review must be summary to uphold the sealing process intended to protect the interests of the owner and third parties, and it is therefore unavoidable that documents seized and subsequently searched may prove to be irrelevant to the investigation.

18. Auszug aus dem Urteil der Anklagekammer vom 10. Mai 1982 i.S. Eidg. Steuerverwaltung gegen X. und Y.

Regeste

Art. 50 Abs. 1 VStrR.
