A legal case was brought before the Swiss Federal Tribunal concerning a direct federal tax issue for the year 2013. The claimant had previously filed a challenge against a decision made by the tax authority of the Republic and Canton of Neuchâtel in June 2015, which was subsequently dismissed by the Cantonal Court in August 2016. The claimant then lodged an appeal with the Federal Tribunal in September 2016, which led to the establishment of two separate case files: one for federal tax and another for cantonal tax. Ultimately, the proceedings related to the federal tax appeal were deemed to have become moot, resulting in the case being removed from the court’s docket.

Used by the instructing judge to justify striking the case from the roll because it concerned the cantonal tax, not the direct federal tax, by citing the procedural rule regarding striking cases that have become obsolete.
