ACT No. XXV of 1980

AN ACT further to amend

the

Prevention

of

Disease

Ordinance

(Cap.59).

BE IT ENACTED by the President. by and with the advice and

consent of the House of Representatives. in this present Parliament

assembled, and by the authority of the same, as fol1ows:-

This Act may be cited as the Prevention of Disease Ordinance

(Amendment) Act, 1980, and shall be read and construed as one with

the Prevention of Disease Ordinance. hereinafter referred to as "the

principal law".

Section 99 of the principal law shall be amended as fol1ows

paragraph (w) shall be relettered (z); and

(i)

(ii) immediately after paragraph (v) there shall be inserted

the following new paragraphs

"(w) for controlling

and regulating

the rearing

and

keeping of animals;

(x) for controIling and regulating

the

movement of

animals from one place to another;

(y) for controlling and regulating the collection

and

transport of swill and the feeding of swill to animals. ".

For section 119A of the principal law there shall be substitut­

ed the following

"119A. (1) Notwithstanding any other provision of this

Ordinance, any person who is found guilty of an offence against

any provision of any regulation made under this part of this Ordin­

ance -

(a) where such provision or provisions refer to the im­

portation, movement, or quarantine of dogs or cats, or to the

landing of swil1 from any ship, yacht, pleasure craft, boat or

other vesse l or from any aircraft. shall be liable to a fjne

(multa) o f not Iess th a n two hundred pounds but not exceed­

ing o n e tho u sand pou n d s 01' to imprisonment for a term of

not less than three months but not exc e ed i ng six months; and

(b) in res p ect of any re gulations made under paragraphs

(w), (x) or (y) of section 99 of this Ordinance -

(i) where such p ro vis i on or p ro visio n s refer to the

requireme:nt of any licence 01' authorizat.ion. shall be

liable to a fine (multa) of not Jess than fiv e hundred

pou n ds but not exceeding one thousand p o u n ds : and

(iD for the contravention of any othcr p r o v i s io n or

provisions o f such regulations, shall be liable to a fine

(multa) of not less thaH, fifty pounds but not exceeding

one t h o u sa n d pounds,

(2) The provisions of the Probation of Offenders Aet, J 957.

shaH not be applicable in rc1ation to any offence r ef e rr e d to in para­

g r a p h (a) of subsectioll (l) of this section.".

The s e ct i o n s of the principal1aw hereunder mentioned sha ll be

amended as foHows

(a) in section 101 for the v\'ords "one hundred p ou n d s " there

s hall be substituted the worĠs "five hundred pounds";

in secLion 102 for the words "t e n pounds" there shall be

(c) in section 104 for the words "ten pounds" wherever they

occur in subsections (1) and (2) tbereof. there s h a ll be substituted in

each c ase the words "fifty pounds";

(d) in section 107 for the words "ten pounds" there shall be

substituted the words "fifty pounds";

(e) in section 110 for the words "one pound to five pounds;

in any other case, to a fine (multa) not e xceeding one hundred

pounds" there shall be substituted the words "five p ounds to twenty­

five pounds; in any other case, to a fi n e (multa) not exceeding five

h u n d r ed p ou n ds ";

for paragraphs (a), <b), (c) and (d) of section

(f)

shall be subst i tuted the following

five poun d s where the o ff ence is against sect i on 20;

"(a)

(b) ten p ound s where the offence is a g a i nst paragraph (a)

of section 21 o r section 32;

(c) tw e n ty - fiv e pounds where the offence is against sec­

tion 30; or

(d) two hundred p oun d s where the offence i s against sec­

tion 47.";

in s e ct i o n 112 for the words "ten pounds " there shall be

in section 116 --

(j)

(i) for the words " fif te en pounds" in paragraph (a)

thereof there shall be substituted the words "fifty pounds";

(ii) for the words "four pounds" in paragraph (b) there­

of there shall be substituted the words "twenty pounds"; and

(iiD for the words "ten pounds" wherever they occur in

paragraph (c) thereof there shall be substituted in each case the

words " f if ty pounds"; and

(k) in section 128 for the words "two pounds" there shall be

substituted the words "ten pounds",
