BE IT ENACTED by the President, by and with the advice and con­

sent of the House of Representatives, in this present Parliament as­

sembled, and by the authority of the same, as follows:-

(l) This Act may be cited as the Code of Organisation and

Short title and

Civil Procedure (AmendmenO (No. 2) Act, 1981, and shall be read

commencement

and construed as one with the Code of Organisation and Civil Pro-

cedure, hereinafter referred to as "the principal law".

(2) This Act shall come into force on such date as the Minister

responsible for Justice may by notice in the Gazette appoint.

section 30 of

the principal

(a) in subsection (l ) thereof for the words "The President of

Iaw.

Malta shall appoint the Chief Justice, two others of the judges, and

an advocate nominated by the Chamber of Advocates to be consti­

tuted a Board" there shall be substituted the words "There shall be

a Board composed of the Chief Justice, two judges appointed by

the President of Malta, and the members of the Workings of the

Law Courts Commission"; and

(b) immediately after subsection

(\) thereof there shall be

added the following new subsection

"(lA) The Board may act notwithstanding any vacancy in

its membership but shall not act unless at least the Chief Justice

and two other members are present.".

(d) if, in any other cause, not being one mentioned

in paragraphs (a) or (b) or (c) above, or not being a

cause for personal separation or maintenance, the fees

payable to the Registry in accordance with Tariff A in

Schedule A annexed to this Code, in respect of such

causes, are not paid to the Registrar concurrently with

the request for the reappointment of the cause.".

Art. 5 Amcndment of section %5 of the principal law. — ACT No. Lil of 1981 A N ACT further ta amend the Cade of Organisation and Civil Pracedure, BE IT ENACTED by the President, by and with the advice and con­ sent of the House of Representatives, in this present Parliament as­ sembled, and by the authority of the same, as follows:- Official ↗

For subsection (l) of section 965 of the principal law there

shall be substituted the following

The Court may, on just caUSe being shown, extend,

"(1)

once only, the time prescribed in the last preceding section to a

further period not exceeding two months, on the demand, by appli­

cation, of any party interested, provided such application is filed

before the expiration of the original time.".
