Texte intégral de la décision — Încheierea nr. 4213/2013

Se referă de magistratul asistent asupra faptului că procedura de citare este legal îndeplinită, cererea de strămutare este legal timbrată, comunicată intimaților. Se mai arată că potrivit programului de evidență informatizată a instanțelor, Dosarul nr. 3818/90/2013 a cărui strămutare se solicită se află pe rolul Tribunalului Vâlcea, secția I civilă și are termen de judecată la data de 15 octombrie 2013.

Intimata L.M.V.V. învederează instanței că intimații M.G., L.S., M.M. și M.A. au decedat. Intimata depune copii de pe certificatele de deces ale numiților L.S., L.V. M.M.A., M.T.

Față de precizările intimatei L.M.V.V. privitoare la decesul unora dintre intimați, avocat L.M. pentru petente solicită instanței acordarea unui termen pentru legala citare a succesibililor părților decedate.

Reprezentanta Ministerului Public apreciază ca legal îndeplinită procedura de citare.

Reprezentanta Ministerului Public pune concluzii de respingere a cererii de strămutare.
