Synthèse de l'arrêt (Faits & Considérants)

Généré par l'IA

In a case concerning formal expropriation involving the partial transfer of parcels burdened by building rights, the court determined that the subject of the dispute was moot where parties agreed on compensation amounts, affirming the relevance of the agreed-upon building land price and correcting an apparently miscalculated area. The court ruled that the prior decision improperly issued a partial ruling by only fixing compensation for the land transfer portion but not entirely for the building right transfer, necessitating that both landowners and building right holders have a claim to expropriation compensation, the division of which must be based primarily on the building right interest rate and the duration of the contract, not the criteria used below. Consequently, the case was remanded to the lower court to re-examine and determine the split of the compensation award between the landowner and the building right holders for all affected parcels, without regard to private contractual allocation clauses, while upholding the minimum compensation awarded to the appealing landowner due to the *reformatio in peius* prohibition.

--- · --- · --- · Geschäftsnummer: · VR.2013.00003 · Entscheidart und -datum: · Endentscheid vom 07.11.2013 · Spruchkörper: · 3. Abteilung/3.
