Synthèse de l'arrêt (Faits & Considérants)

Structuré par IA

The appellate court addressed the binding nature of the requests stated in the notice of appeal under Article 221(2) of the Code of Criminal Procedure, where the appellant initially requested affirmation of certain parts of the lower court's judgment and the granting of a suspended sentence with a four-year probation period. Because the subsequent oral appeal motion requested a maximum one-month custodial sentence, which contradicted the written request, the court ruled that, as the law requires a formulated motion, the appellant is generally bound by the requests made in the written appeal declaration after the deadline, precluding consideration of the subsequently modified request for a lesser custodial sentence.

98/99 13 Strafprozessordnung. Art. 221 Abs. 2 StPO. Bindung an die Anträge der Berufungserklärung. Obergericht, 7. Mai 1998, OG S 98 4

Aus den Erwägungen:

1. ... No- vember 1997 in Ziff. ...
