Synthèse de l'arrêt (Faits & Considérants)

Structuré par IA

The appellate court held that the principle of investigation does not grant a party the right to introduce new legal grounds or objections at the appellate stage at any time, meaning a submission filed after the deadline must be disregarded unless reinstatement of the missed deadline is warranted. The court reasoned that disregarding a late submission does not violate the right to be heard, especially since the court is obligated to apply the law ex officio and retains the discretion to consider significant, belated party submissions despite their tardiness.

96/97 29 Verfahrensrecht des Bundes. Art. 108 Abs. 1 lit. c UVG.

= ZAK 1986 S. 190 E. 3b; SVR-Rechtsprechung 1995 BVG Nr. 40 S. 117).
