The Federal Administrative Court (6th Senate) granted the plaintiff's complaint against the non-admission of revision, declaring the appeal admissible on grounds of fundamental legal significance, thereby allowing the case to proceed to the full appellate court for a substantive ruling on whether telecommunications way rights granted via licensing transfer to a successor entity in a statutory merger. The dispute concerned the succession of public path usage rights established under the Telecommunications Act of 1996 during a corporate merger, challenging the lower court's refusal to review the specific legal question of right transferability in such reorganizations. The decision hinged on Section 132(2) No. 1 of the Code of Administrative Court Procedure (VwGO), which permits admission of revision when a case can clarify a general legal question not yet decided by the Federal Administrative Court, specifically regarding the interplay between licensing conditions under Sections 6, 8, and 50 of the Telecommunications Act and the continuity of administrative rights upon the dissolution and transfer of assets.
