The Federal Administrative Court (BVerwG) granted the defendant's complaint for lack of admissibility, admitting the appeal on the grounds of fundamental significance under § 132 Abs. 2 Nr. 1 VwGO. The dispute concerns the compatibility of the state monopoly on sports betting and its associated advertising restrictions with EU law, specifically challenging the legal standard applied to assess this compliance. The court identified two unresolved questions of fundamental importance: whether the assessment of the monopoly's coherence must be uniform across the federal territory or specific to each individual state (Land) given their constitutional autonomy, and whether the legal compatibility is contingent upon a "relocation effect" analysis where players might migrate to more liberally regulated gambling sectors. Other appeal grounds under §§ 132 Abs. 2 Nr. 2 and 3 VwGO were deemed unnecessary to examine due to the success of the fundamental significance argument.

Revisionszulassung; Sportwettenmonopol und Werbung

[GRUENDE]
