Municipal faction funding: Conflict between equal chances principle and allocation strictly based on faction strength
Synthèse Legislator
Généré par l'IAThe Federal Administrative Court (BVerwG) granted leave to appeal, finding the lower instance's rejection of the complaint was erroneous. The case involves a dispute over the allocation of state funds for the financing of municipal council group operations, specifically challenging whether distributions based solely on faction strength violate the constitutional principle of equal opportunities. The court determined the case is of fundamental legal significance under § 132 Abs. 2 Nr. 1 VwGO, as it raises the unresolved question of whether the equal opportunities principle invariably precludes a financing model exclusively tied to faction size or if specific prerequisites allow for such a method.
