The Federal Administrative Court permitted the plaintiff to file an appeal, finding that the legal dispute holds fundamental significance. The case concerns the refusal of a pharmaceutical company's application for the re-approval of a medicinal product due to its failure to rectify deficiencies within a statutory deadline, and the subsequent attempt by the company to rely on an existing approval in another EU Member State to extend the fictitious approval status. The decisive legal issue is whether a pharmaceutical undertaking is barred from invoking approval in another EU Member State under § 105 Abs. 4c AMG to extend a fictitious approval under § 105 Abs. 5 AMG after a rectification period has expired. The court determined this question requires clarification as it affects all pending re-approval proceedings where foreign approvals are claimed, and it provisionally set the amount in dispute for the appeal proceedings.
