The Federal Constitutional Court dismissed the constitutional complaint as inadmissible, denying the applicants reinstatement to their former procedural status; the decision upheld the lower court's prior procedural dismissal. The dispute concerned the missed one-month filing deadline for a constitutional complaint against a Federal Administrative Court decision, with the applicants arguing they were not at fault for missing the deadline because they erroneously believed the period began upon their direct knowledge of the decision, rather than upon notification to their former legal counsel. Relying on § 93(1) and (2) of the Federal Constitutional Court Act, the Court held that the deadline expired on January 7, 2013, while the complaint was filed on January 13, 2013. The Court ruled that a legal misunderstanding regarding the timing of service to a previous representative does not constitute a lack of fault necessary for reinstatement, as a diligent complainant would have anticipated the notification to counsel as the trigger for the deadline and sought immediate legal advice to clarify the correct start date.
