The German Federal Court of Justice (BGH) allowed the defendant's appeal and overturned the lower court's conviction for eight counts of unlawful possession of narcotics in large quantities, ordering a retrial at a different chamber of the Landgericht. The dispute centered on a procedural violation where the first-instance court improperly based its key findings on the "constant statement behavior" of a witness regarding drug quantities, relying on a police officer's report in the judgment text despite the officer never having been formally sworn in and examined as a witness in that specific proceeding. The court held that this error in the composition of evidence was incurable on appeal because the BGH could not independently verify if the main witness had personally confirmed the facts through prior statements. Additionally, the appellate court mandated that the new trial must involve an expert under § 246a StPO to assess potential diminished criminal responsibility (§ 21 StGB) or the necessity of a detention order under § 64 StGB, given the defendant's alleged narcotic addiction and the acquisition of 8.5 kg of cannabis for personal use.
