Généré par l'IA

The case concerns an appeal against a decision related to a claim of material expropriation resulting from the rezoning of land (Abzonung) which reduced the building mass index, leading to a loss of buildable area of approximately 16%. The court reasoned that the standard for assessing compensation in such cases, similar to non-total restrictions from heritage protection, requires determining if the measure prevents a customary, economically sensible, and good use of the property; since the property owners could still achieve a return of 34.47%, and the loss in usable space was not deemed severe enough to constitute an undue burden (Sonderopfer) or shocking legal inequality, the interference lacked the necessary intensity for material expropriation, leading to the dismissal of the appeal.
