Decree No. 94-82 of January 19, 1994 amending Decree No. 75-62 of January 28, 1975 establishing the regulatory provisions applicable to contractual agents of the Ministry of Industry and Research

The following contractual agents may be appointed to the exceptional class, after being listed on a promotion roster established annually following the opinion of the joint consultative committee

those having at least twelve years of seniority as project managers ("chargés de mission");

those having reached the 11th step ("échelon") of their category;

those occupying positions characterized by the exercise of responsibility at the highest level in terms of managing a department, resources implemented, or by the exercise of expert functions requiring high technical qualification.

The concerned parties are, upon appointment, classified at the step corresponding to an index equal to, or failing that, immediately higher than the one they hold in the normal class.

The concerned parties shall retain, in their new step and limited to the duration required for progression to the next step, the seniority acquired in the previous step if the increase thus obtained is less than that which they could have claimed before the change of category by a promotion in the original category, or less than that afforded to them by their access to the next higher step of the original category.

The seniority required at each step to qualify for promotion to a higher step within the exceptional class shall be determined in accordance with the provisions of the table below

The Minister of Industry, Posts and Telecommunications, and Foreign Trade, the Minister of the Budget, Government Spokesperson, and the Minister of the Civil Service shall be responsible, each within his sphere of competence, for the execution of this Decree, which shall be published in the Official Gazette of the French Republic.
