PROTOCOL ESTABLISHING THE MODALITIES OF COOPERATION BETWEEN THE MINISTRY OF FORMER COMBATANTS AND VICTIMS OF WAR AND THE NATIONAL OFFICE OF FORMER COMBATANTS AND VICTIMS OF WAR WITHIN THE FRAMEWORK OF THE POLICY OF REMEMBRANCE AND HISTORICAL INFORMATION The Director General of the National Office of Former Combatants and Victims of War, the Director of General Administration of the Ministry of Former Combatants and Victims of War, and the Delegate for Remembrance and Historical Information have agreed as follows: The departmental historical information committees, for which the directors of the departmental services of the National Office of Former Combatants and Victims of War ensure the general secretariat and financial management, in accordance with the provisions of Decree No. 85-1498 of December 30, 1985 establishing the departmental historical information committees for peace, participate in the implementation of actions defined by the delegation for remembrance and historical information of the Ministry of Former Combatants and Victims of War. These actions fall either within the scope of the application of the annual historical information program provided for by Decree No. 85-1225 of November 15, 1985 establishing the national historical information committee for peace of November 15, 1985; or within the overall mission of coordinating the policy of remembrance in the departments entrusted to the departmental historical information committees for peace by the aforementioned Decree of December 30, 1985. The actions thus entrusted to the directors of the departmental services of the National Office of Former Combatants and Victims of War within the framework of their duties provided for by the aforementioned Decree of December 30, 1985 are those which fall under the competence, as defined by Article 4 of the Decree of March 12, 1992 relating to the organization of the central administration of the State Secretariat for Former Combatants and Victims of War, of the delegation for remembrance and historical information, with the exception of the material safeguarding of places of remembrance. For the implementation of these actions, the directors of the departmental services of the National Office of Former Combatants and Victims of War and their services remain under the exclusive hierarchical authority of the Director General of the public establishment. Relations between the delegation for remembrance and historical information and the departmental services of the National Office of Former Combatants and Victims of War shall proceed according to the following procedures: correspondences from the delegation for remembrance and historical information intended for the departmental services of the National Office of Former Combatants and Victims of War are addressed to them through the departmental prefects. The Director General of the National Office of Former Combatants and Victims of War receives copies of correspondences addressed to the departmental services for opinion or information; correspondences requiring action are submitted to him beforehand; correspondences from the departmental services of the National Office of Former Combatants and Victims of War intended for the delegation for remembrance and historical information are addressed directly by these services, which simultaneously transmit copies to the departmental prefect and to Mission E 2 of the National Office of Former Combatants and Victims of War. The distribution of competencies regarding historical information between the interdepartmental directorates of the Ministry of Former Combatants and Victims of War and the departmental services of the National Office of Former Combatants and Victims of War may not result in either party issuing instructions or directives to the other. This applies, in particular, to the actions specifically entrusted to the departmental services of the National Office of Former Combatants and Victims of War as general secretaries of the departmental historical information committees for peace. When the missions assigned to the departmental services of the National Office of Former Combatants and Victims of War for the organization of commemorative ceremonies or exhibitions make it desirable to provide them with equipment resources or the cooperation of personnel from the interdepartmental directorates of the Ministry of Former Combatants and Victims of War, this collaboration shall be defined and agreed upon by joint decision of the director of the departmental service of the National Office of Former Combatants and Victims of War and the interdepartmental director concerned. The execution of the missions thus defined, as well as the management of the related resources, shall then be entrusted, for the duration of the mission in question, to the director of the departmental service of the National Office of Former Combatants and Victims of War. The personnel of the interdepartmental directorates concerned remain under the administrative authority of the interdepartmental director. The National Office of Former Combatants and Victims of War ensures the functioning of the departmental historical information committees for peace. To this end, the Ministry of Former Combatants and Victims of War shall annually pay the public establishment a global operating endowment, the amount of which shall be fixed by mutual agreement by the Director General of the National Office of Former Combatants and Victims of War, the Director of General Administration, and the Delegate for Remembrance and Historical Information, based on an annual report relating to the functioning of the departmental historical information committees for peace, prepared by the National Office of Former Combatants and Victims of War. This global operating endowment may in no case cover staff costs. It shall be paid to the National Office of Former Combatants and Victims of War through the Directorate of General Administration, and charged to budget chapter 43-02. The funding for the actions defined in Article 2 of this protocol shall be provided by the delegation for remembrance and historical information by means of quarterly allocations paid to the National Office of Former Combatants and Victims of War upon presentation of projects by the departmental historical information committees for peace and taking into account the effective use of intervention appropriations allocated to the departmental services of the National Office of Former Combatants and Victims of War during the preceding quarter. The modalities for implementing the financial provisions set out in Articles 7 and 8 of this protocol shall be specified in a circular co-signed by the Director General of the National Office of Former Combatants and Victims of War, the Director of General Administration, and the Delegate for Remembrance and Historical Information.
