177.111 Executive Ordinance to the Personnel Act (VVO)

Official Secrecy § 143. 1 Employees may only make statements as a party, witness or court-

appointed expert regarding observations made in the exercise of their duties

if the Directorate or the competent

supreme cantonal court has authorized them to do so. Information obligations

under the Cantonal Council Act remain reserved.

2 The Directorates may delegate this competence to the directly

subordinate offices, departments, and operations; the supreme cantonal

courts may delegate it to the courts or to the Notary Inspectorate.

3 This authorization must also be obtained after the

employment relationship has been terminated.

Ancillary § 144. 1 The following are responsible for granting a permit

Employment a. for administrative personnel, the Directorate or the office authorized

by it; in the case of participation in the administration of a

legal entity with economic interests, the Directorate,

b. for judicial personnel, the competent supreme cantonal

court or the court or Notary Inspectorate authorized thereto.

2 Before taking on ancillary employment, the appointing authority

must be informed. This authority decides whether a permit

must be obtained. It can also subsequently and on its own initiative

demand that a permit be obtained.20

3 Working time claimed for ancillary employment primarily

exercised in the interest of the service does not need to be compensated.

Ancillary income, with the exception of expense allowances, must be paid

to the State Treasury in a reasonable proportion to the working time expended,

unless the working time is compensated.

4 Working time claimed for ancillary employment primarily

exercised in one's own interest must generally be compensated,

except for charitable ancillary employment up to half a day per week.

Time compensation is in no case to be qualified as overtime. The

permit may be linked to the condition that an appropriate part of the

ancillary income be paid to the State Treasury if working time compensation

is not possible or only partially possible.

Public § 145. 1 The following are responsible for authorizing public offices

Offices a. for administrative personnel, the Directorate or the office authorized

thereto; in the case of taking on a mandate as a member of the

Federal Assembly or the Cantonal Council, the Government Council,

b. for judicial personnel, the competent supreme cantonal

court or the court or Notary Inspectorate authorized thereto.

2 If the public office requires working time of more than half a

day per week, this must generally be compensated.

3 Employees may be obliged to pay an appropriate part of the

ancillary income to the State Treasury if the prescribed compensation

of working time is not possible or only partially possible.
