Purchase Agreement between the Treasury of the Canton of Zurich and the Municipality of Rüdlingen concerning the Stäubisallmend

1 The Municipality of Rüdlingen transfers ownership to the Treasury of the Canton of Zurich of

the so-called "Stäubisallmend," consisting mainly of scattered land, bordering

to the east on land belonging to the Municipality of Flaach and various landowners;

to the south on land belonging to Kaspar Lienhard, brickmaker, in Flaach, Jakob Meier, former district judge, in Flaach, and Widow Fehr, municipal clerk, in Rüdlingen;

to the west on the high dam and the Rhine;

to the north, the area tapers off.

2 The surface area of the property being purchased, excluding the parcel of land serving as an access road, which is nevertheless included in the purchase, measures 7 (seven) hectares, 50 (fifty) ares, and 20 (twenty) square meters [20 (twenty) Jucharten, 335 (three hundred thirty-five) Ruthen, and 55 (fifty-five) square feet].

3 The Municipality of Rüdlingen shall, upon execution, assign the cadastral plan of the Stäubisallmend, currently in its possession, to the purchaser.

§§ 2-6.

Through the transfer of the Stäubisallmend, including the parcel of land serving as an access way, to the Canton of Zurich's Treasury, the circumstances concerning the affiliation of the Stäubisallmend are to be considered settled, and it indisputably belongs, for all future, including the land serving as an access way, to the municipal territory of the political municipality of Flaach.

Regarding the border line between the Cantons of Zurich and

Schaffhausen, the contract of 30 August / 15 September

18702, which was agreed upon between the two governments of Zurich and

Schaffhausen, remains in effect, in the sense that the middle of the

Rhine on the stretch mentioned in that contract forms the cantonal border.

Sales Contract concerning the Stäubisallmend

The two contracting parties reserve the approval of the superior authorities for the present contract. The Governments of the Cantons of Zurich and Schaffhausen shall ensure that both the present contract and the one from the year 1870 achieve full constitutional validity.
